    MyKey Locksmith – Terms & Conditions

    1) Acceptance of These Terms

    By accessing mykeytx.com (the "Site") or requesting any mobile/on-site locksmith service from MyKey Locksmith ("Company," "we," "our," or "us"), you ("Customer," "you," or "your") agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Site or our services.

    2) Who We Are & Service Area

    We provide professional locksmith services across the Dallas–Fort Worth metroplex and surrounding areas. Where licensing is required, we operate under: Texas DPS Locksmith License No.: B31013001. We are insured as required by applicable law.

    3) Eligibility & Authority

    You represent that you are at least 18 years old and authorized to request service for the property or vehicle in question. You agree to provide accurate identification and proof of ownership/authorization if requested.

    4) Ownership & Authorization Verification (Very Important)

    • Property/Vehicle Proof: We may require government-issued ID, proof of registration, proof of insurance, title, or written authorization from the owner/manager.
    • Refusal of Service: If ownership/authorization cannot be verified to our reasonable satisfaction, we may refuse or discontinue service without liability.
    • Misrepresentation: You are solely responsible for any misrepresentation regarding ownership or authorization and agree to indemnify us for resulting claims (see §18).

    5) Quotes, Pricing & Payment

    • Estimates: Telephone/online quotes are estimates only based on the information you provide. Final pricing may vary due to site conditions, lock type/condition, required parts, labor time, accessibility, after-hours/holiday surcharges, and travel.
    • Minimums & Diagnostics: A minimum service/dispatch or diagnostic fee may apply once a technician is en route or on site, even if no work is performed.
    • After-Hours/Holiday Rates: Premium rates may apply for nights, weekends, and holidays.
    • Taxes/Fees: Prices exclude applicable taxes and third-party fees unless stated.
    • Payment Due: Payment is due immediately upon completion of work, unless otherwise agreed in writing. We accept the payment methods listed on the Site. You authorize us to collect payment using your provided method.
    • Chargebacks: You agree not to file chargebacks without first giving us a reasonable opportunity to resolve any dispute in good faith.

    6) Scheduling, Arrival Windows & Cancellations

    • Service Estimates: Quoted service times are estimates and are not commitments; traffic, weather, emergencies, or prior jobs may cause delays.
    • Cancellations: Cancelling after a tech has been dispatched may incur a dispatch/no-show fee.
    • No Access: If we cannot access the work site or you are not present within a reasonable time, a no-show fee may apply.

    7) On-Site Work Risks & Release (Locks, Doors, Vehicles)

    Locksmith work can involve non-destructive methods first when feasible. However, due to lock condition, prior damage, security features, or required speed (e.g., emergencies), destructive entry (e.g., drilling) may be necessary.

    • Pre-Existing Conditions: We are not responsible for pre-existing damage, wear, manufacturer defects, or hidden conditions.
    • Reasonable Care: We will exercise reasonable care, but you acknowledge that some procedures can cause cosmetic/structural impact to locks, doors, frames, ignitions, trim, weather-stripping, glass, or vehicle modules.
    • Programming & Electronics: Key/fob programming involves third-party software/hardware and vehicle modules. You accept the risk of intermittent or subsequent electronic issues unrelated to our workmanship.
    • Customer Acknowledgment: By authorizing the work, you accept these risks and release us from liability for unavoidable or incidental damage to the maximum extent permitted by law.

    8) Parts, Materials & Third-Party Products

    We may use OEM or high-quality aftermarket parts at our discretion unless you request otherwise in writing. Manufacturer warranties (if any) are provided by the manufacturer, not by us. We are not responsible for third-party delays or defects, but we will reasonably assist with warranty claims where applicable.

    9) Limited Warranty (Workmanship)

    • Coverage: We warrant our workmanship for 90 days from the service date. We will repair or re-perform defective workmanship at our option.
    • Exclusions: This warranty does not cover: normal wear; abuse/misuse; neglect; accidents; vandalism; weather; corrosion; electronic interference; third-party repairs/alterations; customer-supplied parts; pre-existing issues.
    • Exclusive Remedy: Your exclusive remedy is repair/re-performance of the specific defective workmanship.
    • Disclaimer: Except as expressly stated, we disclaim all other warranties to the fullest extent permitted by law.

    10) Returns, Refunds & Exchanges

    Custom-cut keys, programmed keys/fobs, opened electronic components, and labor already performed are non-returnable and non-refundable unless required by law. Any approved returns may be subject to restocking or service fees.

    11) Customer Responsibilities

    Provide safe access, accurate information about the issue and lock/vehicle type, and notify us of any special conditions (e.g., alarm systems, pets, hazardous conditions). You agree to clear the work area and follow technician safety instructions.

    12) Prohibited Uses

    You may not request services for illegal purposes or to gain unauthorized entry. We may refuse service and will cooperate with law enforcement where appropriate.

    13) Website Use & Content

    The Site is provided "as is." We strive for accuracy but do not commit that content, pricing, or availability information is error-free. We may correct errors or update information without notice.

    14) Intellectual Property

    All content on the Site (text, logos, graphics, photos, code) is owned by us or our licensors and protected by IP laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

    15) User Reviews & Submissions

    If you post or submit reviews, photos, or feedback, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content for marketing and service improvement, subject to applicable law. Do not submit unlawful, defamatory, or infringing content.

    16) Communications; Call Recording; SMS Terms

    • Consent: You consent to us contacting you via phone, SMS, MMS, email, and other channels for scheduling, service updates, and (with your consent) marketing.
    • Text Program: Message/data rates may apply; message frequency varies. Reply STOP to opt out and HELP for help. Carrier is not liable for delayed/undelivered messages.
    • Recording: Calls and communications may be monitored/recorded for quality and training where permitted by law.

    17) Privacy

    Our collection and use of personal data are described in our Privacy Policy (see the link in the footer). By using the Site/services, you agree to that policy.

    18) Indemnification

    To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless the Company and its owners, employees, and contractors from claims, damages, liabilities, costs, and fees arising out of: (a) your breach of these Terms; (b) your misrepresentation of ownership/authorization; (c) your illegal use of our services; or (d) your negligence or willful misconduct.

    19) Disclaimers

    EXCEPT AS EXPRESSLY PROVIDED IN §9, THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.

    20) Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR: (A) ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES; (B) LOSS OF USE, DATA, BUSINESS, REVENUE, OR PROFITS; OR (C) AMOUNTS EXCEEDING THE TOTAL FEES YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. NOTHING HERE LIMITS LIABILITY FOR OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.

    21) Force Majeure

    We are not liable for delays or failures due to events beyond our reasonable control (e.g., severe weather, accidents, supply disruptions, labor issues, war, acts of government, utility outages).

    22) Dispute Resolution; Arbitration; Governing Law

    • Informal Resolution: You agree to first contact us to try to resolve any dispute informally before pursuing formal resolution.
    • Arbitration: Except for small-claims matters, any dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association under its rules.
    • Class Action Waiver: You may only bring claims in your individual capacity, not as a class representative or member.
    • Venue & Law: These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Venue for any court action (e.g., to compel arbitration or for small claims) lies in Dallas County, Texas.

    Note: Some jurisdictions impose requirements/limitations on arbitration and waivers. If a specific provision is unenforceable, the remainder still applies (see §24).

    23) Electronic Signatures & Notices

    You agree that electronic signatures and records satisfy legal requirements. We may send notices to the email/phone/address you provide or via the Site. You are responsible for keeping your contact details current.

    24) Severability; Waiver

    If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the fullest extent permitted and the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver.

    25) Changes to the Terms

    We may update these Terms at any time by posting a revised version on the Site with a new "Last Updated" date. Your continued use after changes constitutes acceptance.

    26) Entire Agreement

    These Terms, together with the Privacy Policy and any service-specific order/estimate you sign or approve (including SMS consent), constitute the entire agreement between you and us.
